This is the probated last will and testament of Abraham Bennett of the town of Saratoga, Saratoga County, NY, dated January 11, 1858, admitted to probate February 25, 1861 before Surrogate C. A. Waldron. (Given the 1858–1861 gap, Abraham Bennett likely died sometime in late 1860 or early 1861.)
The Bennett family named in the will
Abraham Bennett names his children as follows:
Mary Dennis — daughter, wife of Henry W. Dennis of the town of Saratoga — bequeathed $300
Sarah Ann Salisbury — daughter, explicitly identified as "wife of Lewis Salisbury of the town of Saratoga aforesaid" — bequeathed $300
George W. Bennett — son, named residuary heir and executor, inheriting the bulk of the estate (real, personal, and mixed property) subject to paying out the other legacies
Chauncey Bennett — son — bequeathed $1,000, paid half within one year of decease, half within two years, without interest
Nathaniel M. Bennett — son — bequeathed $1,000 on the same payment terms as Chauncey
All three sons — George W., Chauncey, and Nathaniel M. Bennett — were appointed as executors of the will. The will was witnessed by William B. Deuel (of Saratoga Springs) and Mark J. Caldwell (of the town and county of Saratoga), both of whom testified at probate that Abraham Bennett was of sound mind, over 21, and not under restraint when he signed.
